The Department handles all state criminal appeals cases and assists district attorneys with complex criminal cases at their request. Description of Work Recruitment Range: $116,147 - $130,266 IMPORTANT NOTE: This posting closes at 11:59:59 PM the night BEFORE the End Date listed. • Preparation and trial of criminal cases which the Special Prosecutions Section of the Attorney General’s Office may be requested to prosecute, and preparation of the State’s response and representation of the State in post-conviction motions for appropriate relief. These cases involve offenses of every variety which may arise by virtue of a conflict of interest, the degree of difficulty or some other problem taking the case out of the normal local case management. Specialization will be concentrated on complex criminal litigation in the areas of official corruption, drug trafficking, first-degree murder, and rape and sex offense cases. • Trial preparation may be in consultation with or independent of local district attorneys and involves the review and evaluation of cases and factual allegations out of which cases may arise to determine whether the case is sufficient for prosecution and, if not, wherein and to what extent the insufficiency may properly be supplied. Trial preparation also includes research and preparation of legal memoranda of law and trial briefs and motions on behalf of the State. • Actual trial of cases of the type described above, either alone or with the assistance of the local district attorney, includes preparation and interview of prospective witnesses, conferences with opposing counsel, pretrial conferences, argument of pretrial motions, selection of jurors, examination and cross-examination of witnesses, arguments on questions of law to the judge and summation to the jury. • Provides to district attorneys and prosecutors assistance in the form of advice and case law or statutory support on questions of criminal law and/or procedure, constitutional law, rules of evidence, law enforcement techniques, and trial tactics and strategy. • Provide advice and assistance to the State Bureau of Investigation and local law enforcement on criminal law, procedure and investigative techniques. • Researches and prepares written briefs and oral arguments for the Court of Appeals and Supreme Court of North Carolina and Federal courts of criminal appeals with an emphasis on capital case litigation. • Represent officials of the State criminal justice system, the Attorney General and Governor in civil actions. Essential Function: “Department attorneys must comply with applicable rules of professional conduct”. Some travel, including some occasional overnight stays are required The selected candidate is subject to a background investigation. The Special Prosecutions and Law Enforcement Section supports and provides legal advice to District Attorneys and law enforcement across the State in addition to representing the State of North Carolina in both criminal and civil litigation. Knowledge Skills and Abilities/Management Preferences Jury trial experience as first chair.
